Contract Terms and Provisions
Terms
The following terms and provisions pertain to all fabrication orders placed with Tile Market of Delaware’s Stone Shop division.
Order Placement and Scheduling
Because we work in a very time sensitive production environment, it is necessary that we have certain information before we can schedule your project. Jobs will not be scheduled until we have the following:
- Signed Contract
- Signed Slab Approval
- Deposit Paid (if applicable see terms below)
Payment Terms
- Non-Credit Account Customers:
- 50% deposit with signed contract
- Balance due after template and prior to install
- Any adjustments to scope or size of job discovered at template will be adjusted into this final payment. Failure to make final payment prior to install will delay your install and it will be rescheduled. Applicable reschedule fees will apply.
- Any order $2,000 or less must be paid for in full at the time the order is placed. All “material only” orders must be paid for in full at the time the order is placed.
- Credit Account Customers:
- 50% will be billed at time of template
- 50% (or Balance) billed at time of install*
*Any adjustments to scope or size of job discovered at template will be adjusted into this final payment.
“Material Only” orders will be invoiced at the time the order is placed.
Other Provisions
Job Size Change
Occasionally there are changes in overall scope or dimensions discovered at time of template or after template has been programmed. Since all quotes are based on specific dimensions and quantities, the customer’s contracted dollar amount will be adjusted to reflect such changes and the balance will be due prior to install for non-account customers. Account customers will be invoiced at the adjusted dollar amount.
Seam Placement and Slab Layout
Seam placement and slab layout is a function of slab size, cabinet layout, grain flow, material integrity, cut outs, manual product movement capability, job site conditions, and several other variables. Tile Market of Delaware reserves the right to place the seam, or seams, where we deem to be the most appropriate place. Slab layout begins in one of the four corners of the slab. Starting a layout in the middle of a slab greatly increases the waste factor. We do understand that there may be times when doing so is desired by the customer. This can be accommodated however, any requests to do so must be detailed in the job quote, a digital layout fee will be assessed, and the additional waste will be added to the contracted amount. Actual seam placements and slab layout cannot be determined until after the digital template file has been programmed after template. Any discussion about seam placement or slab layout with your sales person is only speculative and cannot be guaranteed unless the customer purchases a digital layout. By scheduling a digital layout, you can visually see the seams and slab layout prior to fabrication.
Digital Lay-Out
Digital layout’s which allow the customer to view the slab layout and slab seam placement digitally prior to fabrication is an option for a fee (determined by the size of the layout). Photos of the layout will be emailed to the customer, or they can be viewed at Tile Market, for their approval. This option is time sensitive and the customer layout should be approved within 24 hours of receipt of their layout. Delays in getting customer approval may cause the fabrication and installation dates to be modified and pushed back.
Pre-Template Checklist
The Stone Shop Pre-Template Checklist must be completed prior to template. Failure to comply may result in a reschedule and delay.

The Stone Shop Pre-Install Checklist must be completed prior to install. Failure to comply may result in a reschedule and delay.
Template or Install Cancellations or Re-schedules
Any cancellations or re-schedules within 24 hours will be subject to $150 fee.
